9,000 Rape Kits are Left Untested in U.S.

May 28, 2015

An exclusive CBS investigation revealed that over 9,000 rape kits are left untested. Such evidence is critical not only for law enforcement and prosecutors seeking convictions, but importantly to criminal defendant’s standing trial for rape or sexual assault accusations. Moreover, uncorroborated eyewitness accounts or identification is a growing concerning the criminal justice system. The innocence project, on a weekly basis, reports persons convicted of rape or murder offenses, but the convictions are ultimately overturned after DNA testing proves the convicts innocence. Similarly, without the use of physical evidence, especially in a rape trial where identification of the suspect is critical, leaves open the door of misidentification leading to wrongful convictions of innocent people. This is an accepted point not only among the criminal defense attorney community, but prosecutors and law enforcement as well. Click here for more information or read the article for yourself.
