List of Common California “Wobbler” Offenses
A wobbler offense is when the crime could be charged as either a felony or misdemeanor. The prosecuting agency holds this discretion and will consider the following factors:
• Your prior criminal record• The level of injury your accuser received
• The planning and/or sophistication of your crime
• Whether you committed other crimes at the same time or on different occasions
Fortunately, if you’ve been convicted of a wobbler offense, you may be eligible to reduce your felony to a misdemeanor under Penal Code 17(b) after successful completion of your probation period. The following list are common wobbler offenses:
