Costa Mesa Couple to Stand Trial for Road Rage Murder of Child Victim

On March 30, 2022, the Orange County District Attorney reported in a press release that a judge ordered a Costa Mesa couple to stand trial in the murder of a 6-year-old boy during a road rage incident on the 55 freeway earlier this year.

Marcus Anthony Eriz, of Costa Mesa, is charged with one count of murder, one count of shooting into an occupied vehicle, and one felony enhancement of the personal discharge of a firearm causing great bodily injury. He faces a maximum sentence of 40 years to life in prison if convicted.

Wynne Lee, of Costa Mesa, is charged with one felony count of being an accessory after the fact and one misdemeanor count of having a concealed firearm in a vehicle. She faces a statutory maximum of 3 years in prison if convicted.

Lee has been released on electronic monitoring and Eriz is currently being held without bail.

According to the evidence at their preliminary hearing, at 8:00 a.m. on May 21, 2021, 6-year-old Aiden Leos was shot and killed while in the back seat of his mother’s car on the 55 freeway. Leos was on his way to kindergarten in Yorba Linda.

The California Highway Patrol launched an investigation and manhunt for the shooter that spanned Southern California. Lee and Eriz were arrested two weeks later.
