Former Border Patrol Agent Pleads Guilty to Four Federal Charges

A former United States Customs and Border Protection agent pleaded guilty on Wednesday to charges of running an illegal gun selling business, unlawfully possessing over forty machine guns, tax evasion, and failing to disclose his foreign financial interests in China prior to obtaining security clearance.

Wei Xu pleaded guilty to four federal felony charges, including making a false statement to federal investigators. His sentencing hear is scheduled for January 4, 2020 before U.S. District Judge R. Gary Klausner. He faces up to 25 years in federal prison. Xu has been in federal custody since his arrest back in February of this year.

According to his plea agreement, Xu sold four firearms out of the trunk of his car to undercover agents posing as buyers. The firearms were described as “off-roster” pistols and high-capacity magazines, and a short-barreled rifle.

A subsequent search of Xu’s residence yielded more than 250 firearms, including 41 full-automatic firearms or machine guns.

This case was investigated by the Federal Bureau of Investigation, Bureau of Alcohol, Tobacco, Firearms, and Explosives, and IRS Criminal Investigation.
