Statute of Limitations for PC 273.5(a) Increases from 3 to 5 Years

In California, prior law barred felony prosecution for penal code 273.5(a) after three (3) years of the date of occurrence. California senate bill 273 codified penal code 803.7 pc which increases the statute of limitations to five (5) years.

According to PC 803.7, prosecution for a felony violation of PC 273.5 may be commenced within 5 years from the date of occurrence. Additionally, this section applies to all cases that arise after January 1, 2020. However, the statute is partially retroactive making is applicable to crimes committed earlier than January 1, 2020 for which the statute of limitations has not elapsed.
