California Appellate Court Dismisses Case Against Defendant Charged with Child Sex Crimes

On Tuesday, the Court of Appeal for the Second District of California dismissed the case against Naason Garcia who was awaiting trial on child rape and human trafficking charges in Los Angeles. Garcia is a self-proclaimed megachurch leader from Mexico who is charged with crimes against three women. It is said that Garcia has approximately 5 million followers worldwide. The prosecution added possession of child pornography charges shortly after Garcia was arrested.

The appellate court ruled that the Los Angeles Superior Court must dismiss all the counts including forcible rape on a minor and child pornography. The appellate court’s decision was based on procedural grounds and not anything substantive to the offense. Moreover, the court ruled that Garcia’s preliminary hearing was not held in a timely manner nor did he waive his right to one. Accordingly, under California law, the charges must be dismissed. However, this does not preclude the prosecution from refiling the charges against him.
