Overview of California Burglary Charges

In California, there are three forms of burglary: (1) residential; (2) commercial; and (3) auto. Charges of burglary are codified under penal code 459 pc making it a crime to enter a structure with the intent to commit a felony or theft. Each form of burglary is fact specific and particular in the form of the structure the alleged burglary occurred. Generally, burglary requires the government to prove:

  1. You entered a structure;
  2. You harbored the intent to commit a felony or theft crime.

  • Commercial Burglary: Recent revisions in the law have affect the charge of commercial burglary. If the property amount exceeds $950, then the crime becomes a wobbler allowing the prosecutor to charge you with either a felony. An amount under $950 is ordinarily shoplifting (unless the defendant is a registered sex offender, or suffers from a prior “super strike,” or the offense was not carried out in normal business hours). A conviction for felony commercial burglary carries a sentence of 16 months, 2, or 3 years in county jail. A misdemeanor conviction carries up to 1 year in the county jail.
  • Auto Burglary: Auto burglary is a wobbler and it is not a strike offense. It carries the same sentencing guidelines as commercial burglary above.
